The operation of our emate platform cannot do without the processing of your personal data.
However, we value your privacy and will process all personal data in accordance with applicable law and this policy adopted to protect it.
The policy provides you with full information on how and why we process your personal data.

General on the processing of personal data
In the operation of the eMate platform, personal data of players and guides is collected and processed.
However, all users can rely on the fact that:
- we will not do anything with their data that we have not informed them of in advance,
- we will keep all data reasonably secure throughout its processing,
- we will delete the data once we no longer need it for any of the purposes mentioned,
- we will not pass on data to any third parties without their prior knowledge, unless such an obligation arises directly from the law.

If you visit the website of our platform: www.emate.gg without registering, we process information about your visit using cookies - small text files that are stored directly on your device.
Some cookies are necessary for the operation of the site, all other cookies will only be placed on your device with your prior consent.

Registration
In order to take full advantage of our platform, you need to register – create your user account.
We will process the data provided during registration on the basis of the necessity of such processing for the fulfilment of our contractual obligations. These are further regulated in the digital services contract that we conclude with you in accordance with our terms and conditions.
With a user account you will be able to contact the guides and maybe even play with them.
We will process the personal data stored in the user account for the duration of its existence. You can cancel it at any time directly on the website – in this case, the personal data will be deleted, except for those that we also process on the basis of another legal title.
Buying credits
When purchasing credits, payment details are processed through a payment gateway. The payment gateway is provided to us by a trusted third party and eMate never processes your payment information directly.
We will always process the transaction history for three years after cancellation of the account, and this is based on our legitimate interest in protecting our legal claims. The persons concerned may object to this form of processing at any time by contacting us using the contact details above.
Guided game
On our platform, anyone can become a guide and offer gaming accompaniment for a fee. We only provide space for players and guides to do so, allowing them to pay for the accompaniment safely and for both parties to communicate easily.
The guides enter into an accompaniment contract with the players and in this context the guides are the data controllers. However, the processing of this personal data is largely carried out through our platform, so we and the guides together determine the purposes and means of the processing of personal data and are therefore joint controllers in this context.
eMate, as a joint controller, is responsible for the data processing carried out on the platform and fulfils the information obligation towards players and enables them to exercise the rights related to the processing of personal data listed below.
If the guides carry out any part of the processing outside the platform – it is not data processing by joint controllers, but only the specific guide is fully responsible for it. This will be the case, for example, if the guide is obliged to issue a tax receipt to the players, which cannot be done through the platform.
Notification activity
We are a platform under Council Directive 2021/514/EU (DAC7). Therefore, we have to regularly report to the tax authorities the identification data of the guides, a summary of the amounts of remuneration for the quarter, the number of reported activities provided for the period on our platform, etc.

The obligation to transmit this data arises directly from the law and the processing is therefore based on the fulfilment of our legal obligation.
Chat and voice call
The content of written communication made on the platform with the guide is recorded and stored on the platform for 3 years after the user account is cancelled.
The processing of communications after account cancellation is carried out on the basis of our legitimate interest in protecting our rights in the event of any claims by users. The persons concerned may object to this form of processing at any time by contacting us at the contacts listed above.
Voice communication is not recorded by the platform and therefore no personal data of users is processed in this context.
Sending commercial communications
We don't want to bother you with any spam, but we would like to keep you informed from time to time about what's new on the platform.
Unless you opt out when you register, we will send you commercial communications based on our legitimate interest in self-promotion. In any case, you will receive no more than one email from us per month containing news about our platform and related activities.
If you change your mind, you can unsubscribe at any time in the future using the unsubscribe link at the bottom of every email you receive from us or directly in your user account.
Reviews
Player reviews are automatically posted on the platform about their experience with each guide.
The processing of reviews is done based on our legitimate interest in providing quality feedback to guides and sharing experiences with other players – i.e. for the smooth functioning of the platform.
We do not interfere with the reviews and publish them all indiscriminately on the profile of the guide. The persons concerned may object to this form of processing at any time by contacting the contacts listed above.
Processors
If we need help with processing, we will choose a trusted partner and enter into a data processing agreement with them.
We engage processors mainly in the accounting and tax area, in web hosting, in legal consultations and, if necessary, in other areas.

The relevant legislation links a number of rights of data subjects – i.e. you – to the processing of personal data.
These include in particular the right to information, i.e. your right to ask us for information about the categories of personal data processed, the purpose, duration and nature of the processing and the recipients of the personal data. This information is set out above, but we will be happy to explain it in more detail if you wish.
You also have the right to request a copy of the personal data processed – some of which is available on your profile if you create one on the website.
If any of your data changes or if you discover that we are processing inaccurate personal data, you have the right to have it corrected. We will be happy to correct the inaccuracy of your data without undue delay, you can also edit it on your profile.
Provided certain conditions are met, you have the right to erasure or the right to restrict the processing of your personal data. If the legal conditions are met, we will delete or restrict the processing of your data upon request.
Finally, you have the right to object to or complain about the processing of your data. The objection is sent to us and can be directed against processing carried out on the basis of legitimate interests or any form of direct marketing. You can submit a complaint to the Data Protection Authority at any time.
